Terms and conditions of Fan26 services (“Conditions”)

These Terms and Conditions - available on the website milanocortina2026.org ("Site"), together with the information notice pursuant to Article 13 of the EU Regulation 2016/679 ("GDPR") - govern the terms and conditions of Fondazione Milano Cortina 2026 with registered office in Milan, Piazza Tre Torri, n.3 - 20145 (MI) ("Milano Cortina 2026") for the participation in Fan26 and related services (as defined in art. 2 below) by people with sporting aptitudes or even just sport lovers who are at least 14 years old ("Fans").

Milano Cortina 2026 believes that the active and participative involvement of a considerable number of people can represent an added value for the Winter Olympic Games to be held on the Italian territory ("Games") and for the promotion of the Italian territory. By interacting with the Fans or involving them in different initiatives, they are given the opportunity to approach different sports practices in the spirit of the Olympic Charter and the Olympic and Paralympic values.

Milano Cortina 2026, therefore, intends to offer Fans such an opportunity, also through the receipt of offers from the partners of Milano Cortina 2026 referred to in Art. 4 below and invitations to sporting, cultural, and/or other events, always in compliance with the provisions of art. 5 below.

The complete list, periodically updated, of specific Services (as defined in Art. 2) and of any related regulations and/or particular conditions (the Regulations and particular conditions, hereinafter, for the sake of brevity, individually and/or collectively the "Regulations") is available on the Site. The Regulations constitute an integral and substantial part of these Conditions. In the event of any discrepancy between the provisions of the Regulations and the Conditions, the provisions of the Regulations shall prevail.

Fans are advised to print or save a local copy of the Conditions and Regulation for future reference.

Participation in Fan26 is free of charge and subject to full acceptance of these Conditions and any subsequent modifications. Registration can take place in the following ways: (i) after creating the Olympic ID via the link available at the following address https://www.olympics.com/en/sign-in?origin=https://fan26.olympics.com/en/fan26&template=mico-2026, or (ii) registration via the online form on the Website [https://digital.milanocortina2026.org/it/fan26. In either case, you must proceed to create the Olympic ID and accept these Conditions.

Each registration is nominative and implies that the Fan provides certain personal data, which will be processed in accordance with the Information Notice available at the link https://milanocortina2026.org/en/information-notice-processing-personal-data. The Fan undertakes to provide true, accurate, updated, and complete information, guarantees its correctness and is solely responsible for it. The validity of the registration is also subject to the provision of a personal e-mail address to which correspondence concerning Fan26 can be sent.

Milan Cortina 2026 reserves the right:

• to send, subject to acceptance of these Conditions and creation of the Olympic ID, “institutional” communications relating to the organisation of the 2026 Olympic and Paralympic Winter Games in Milan Cortina;
• upon collection of Fan's consent, to offer promotional initiatives, also in line with Fan's preferences, as detailed in the Information Notice available here https://milanocortina2026.org/en/information-notice-processing-personal-data. Through participation in such promotional initiatives, the Fan may receive a number of advantages over the Fan26 programme.

Milano Cortina 2026 reserves the right to refuse participation in the Fan26 to applicants not meeting the requirements set out in these Conditions, or to revoke their registration - with consequent exclusion - if it is subsequently ascertained that they do not meet these requirements.

The Fan has the right to request deletion from Fan26 at any time in the manner set out in Art. 6 of these Conditions. If, on the other hand, you wish to delete your Olympic ID, resulting in your exclusion from the world of the 2026 Olympic and Paralympic Winter Games in Milan Cortina, please refer to [https://www.olympics.com/en/sign-in?origin=https://fan26.olympics.com/en/fan26&template=mico-2026].

By accepting these Conditions and the Regulations, the FAN is entitled to receive services exclusively for his direct, personal, and private use, to be enjoyed in full compliance with the Conditions ("Services"). The Services listed below are intended as an example and not exhaustive and may be integrated from time to time, within the scope of Fan26's relevant purposes, at the discretion of Milano Cortina 2026:

• institutional communications related to the 2026 Milan Cortina Olympic and Paralympic Winter Games;
• access to a dedicated section of Fan26 available at https://fan26.olympics.com for content and updates on the upcoming Olympic Games;
• invitation to participate in sporting, cultural or other events;
• where, in accordance with the Information Notice, the Fan expresses his/her consent to this, promotional communications from Milano Cortina 2026;
• where, in accordance with the Information Notice , the Fan expresses his/her consent to do so, sending personalised offers, based on the preferences expressed by the Fan at the time of registration or subsequently updated

It is forbidden for the Fan to engage in behaviour that is manifestly contrary to the Olympic and Paralympic principles, or otherwise prohibited by these Conditions.

The Fan may not in any way falsify or alter the data relating to his/her participation in Fan26, nor make false or misleading statements or provide misleading information.

Any form of transfer of the Services is prohibited, unless expressly agreed with Milano Cortina 2026.

Milano Cortina 2026 reserves the right to carry out checks on the correct use of the Services at any time and without prior notice.

Milano Cortina 2026 reserves the right to exclude the Fan from Fan26 and to revoke the Services that have not yet been used at the time when the exclusion is communicated, if the Fan does not comply with and/or his/her behaviour does not comply with these Conditions, with the applicable laws or provisions or when otherwise they risks to cause damage to Milano Cortina 2026, the International Olympic Committee, the International Paralympic Committee or the relevant members referred to in art. 4 below. Furthermore, in case of objective evidence of just cause, Milano Cortina 2026 has the right to suspend the Fan's participation to Fan26 for the time necessary to carry out investigation activities that it will deem appropriate and/or opportune within the limits of the applicable regulations.

In the event that Milano Cortina 2026 or its assignees become the subject of legal action, disturbances, or other disputes or claims by third parties regarding the behaviour of the Fan or the way in which the latter uses the Services, the Fan expressly undertakes to fully indemnify and hold harmless Milano Cortina 2026 and its assignees from and against any and all liability, loss, damage, cost and any other expense of any nature whatsoever incurred or suffered by the same as a consequence of participation in Fan26, without prejudice to compensation for damages.

The list of Fan26 member partners is always available and can be consulted on the Site.

a. Processing of personal data

The personal data communicated by the Fan at the time of registration will be collected and processed in accordance with the legislation on the protection of personal data and as described in the Information Notice available at the following link https://milanocortina2026.org/en/information-notice-processing-personal-data. In general, if the Fan gives his/her consent, he/she may receive communications (i) of a promotional nature (marketing activities) and/or (ii) in line with the preferences and interests expressed at the time of registration (profiling). In case of lack of consent - and without this circumstance prejudicing in any way the Fan's membership26 having accepted these Conditions - the Fan will receive only institutional communications related to the world of the 2026 Winter Olympic and Paralympic Games of Milan Cortina (so-called light account). 

Should the Fan wish to update his/her data, he/she can do so from his/her profile.

In order to withdraw from Fan26, the Fan shall formulate a written request of withdrawal by sending a communication to the following e-mail address: privacy@milanocortina2026.org, specifying (i) name, surname, date, place of birth and tax code and (ii) the scope of the request. The Fan26 will also be able to withdraw through the right to unsubscribe that can be exercised through the unsubscribe button present in the footer of every communication that he/she will receive from Milano Cortina 2026.

Following the exercise of withdrawal, Milano Cortina 2026 shall proceed without delay to delete the Fan's account and the personal data connected to it. The Fan, in this case, will no longer receive any communication, not even institutional ones.

Milano Cortina 2026 would like to remind you that if the Fan cancels his/her registration to Fan26, his/her Olympic ID will still remain active and he/she will be able to access - always in light of the acceptance of the specific conditions of use - all the other platforms, sites and applications linked to it.

The Fan acknowledges and accepts that the Site and Services are provided on an "as is" and "as available" basis and that they may be temporarily inaccessible or otherwise experience some interruption or malfunctioning.

Milano Cortina 2026 shall not be liable for any loss or damage arising out of or in any way connected with the use of the Services by the Fan, including - without limitation - damages for loss of business, loss of profits, business interruption, loss of business information and/or any other kind of pecuniary loss, except in the event of gross negligence or wilful misconduct of Milano Cortina 2026.

Milano Cortina 2026 reserves the right to amend or supplement these Conditions, or parts thereof, at any time, giving 30 days' prior notice to the Fan, either by general notice published on the Site or by e-mail sent to all Fans.

Amendments or additions to the contract shall be deemed to be accepted in full by Fan if the right of withdrawal is not exercised, in the manner set out in Section 6 of these Conditions, by the date on which the amendments or additions to the contract enter into force.

Fans who do not agree with the new Conditions are kindly requested not to use the Services and to proceed with their withdrawal request from Fan26.

Milano Cortina 2026 reserves the right to notify Fans of any technical changes or updates or novelties concerning the Services via e-mail.

A user previously registered with the FanTeam who, within the 30-day period, (i) has not exercised the right of withdrawal indicated in paragraph 8 of the Conditions and (ii) has not even created his Olympic ID, will remain in the community exclusively through a light account that will only allow the receipt of institutional communications as referred to in point 2 above, always without prejudice to the right to unsubscribe exercisable through the unsubscribe button in the footer of each communication. 

Therefore, when the Fan sends a withdrawal request or exercises the right to unsubscribe, Milano Cortina 2026 will proceed to delete the profile of the Fan, who will therefore no longer be able to participate or receive information on the community. 

It remains clear that the Fan can take part again in Fan26 at any time by creating his/her own Olympic ID via the link available at the following address https://www.olympics.com/en/sign-in?origin=https://fan26.olympics.com/en/fan26&template=mico-2026 and accepting these Conditions.

The invalidity or ineffectiveness of any provision of these Conditions shall in no event result in the invalidity or ineffectiveness of its other provisions.

These Conditions are governed by Italian law.
